Conflicto de jurisdicciones entre la Fiscalía General de la Nación (Fiscalía 11 Filtro Gated de Manizales) y la Inspección 10 Urbana de Policía de la misma ciudad.

La controversia se originó respecto a la competencia para conocer una querella presentada por una ciudadana por el delito de injuria.

En el presente caso, la Sala profirió una decisión inhibitoria, toda vez que, al igual que ocurrió en el auto 780 de 2022, no es posible pronunciarse de fondo frente a una controversia entre una autoridad de carácter administrativo (esto es, el Inspector 10 Urbano de Policía de Manizales) y una autoridad que, pese a ser parte de la Rama Judicial, no actuó en uso de competencias jurisdiccionales (Fiscalía 11 Filtro Gated de Manizales), de esta manera se devolvió el expediente a esta última autoridad, al ser la primera que lo tuvo bajo su conocimiento.
